These Terms of Service (the “Terms”) govern your access to and use of the website at https://portcheck.ing and the port checking tool it provides (together, the “Service”). The Service is operated by the Portcheck.ing team (“we”, “us” or “our”).

1. Acceptance of these Terms

By accessing or using the Service you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Service.

2. Description of the Service

Portcheck.ing is a free online utility that attempts a TCP connection from our server to a hostname or IP address and a port number that you supply, and reports whether that port appeared to be open, closed or filtered from the vantage point of our server. The Service is provided for informational and diagnostic purposes only.

Results reflect a single connection attempt at a single moment in time from a single network location. Firewalls, rate limiting, routing changes, network congestion and intrusion prevention systems can all affect the outcome, so a result is not a guarantee of the actual state of a port.

3. Eligibility

You may use the Service only if you are able to form a binding contract under the laws that apply to you, and only where use of the Service is permitted by those laws.

4. Acceptable use

You may use the Service only for lawful purposes. You agree that you will not:

test a host, network or port that you do not own or operate, and for which you do not have explicit permission from the owner or operator to run such a test;
use the Service to perform reconnaissance for, or any part of, an attack on a system, or to identify targets for unauthorised access;
use the Service to disrupt, overload, degrade or impair the Service or any third party's host, network or infrastructure, including through a denial-of-service attempt;
submit a volume of requests that is unreasonable or automated in a way that interferes with normal operation of the Service, or scrape, crawl or bulk-scan through it;
attempt to gain unauthorised access to the Service, its servers or any related system, or to probe, scan or test the vulnerability of the Service;
circumvent, disable or interfere with any security or rate limiting feature of the Service;
reverse engineer, decompile or otherwise attempt to derive the source code of the Service, except to the extent that this restriction is prohibited by applicable law;
use the Service in any way that violates any applicable law or regulation, including computer misuse, unauthorised access and telecommunications laws in your jurisdiction and in the jurisdiction of the host you are testing; or
misrepresent the results of the Service or present them as an authoritative security assessment.

You are solely responsible for the hostnames, IP addresses and ports you submit and for ensuring that you have any permission that the law requires before running a test.

5. No account, no user content

The Service does not require you to create an account, and it does not host content that you publish. The values you submit are used only to carry out the check you requested. Our handling of that data is described in our Privacy Policy.

6. Availability and changes to the Service

The Service is provided free of charge and on an as-available basis. We may modify, suspend, limit, rate-limit or discontinue the Service, in whole or in part, at any time and without notice or liability to you. We do not guarantee any level of availability, uptime, capacity or response time.

7. Intellectual property

The Service, including its name, design, text, graphics and underlying software, is owned by us or our licensors and is protected by applicable intellectual property laws. These Terms do not grant you any right to use our trademarks, logos or branding. The factual results of a check that you run are yours to use freely.

8. Third-party links, advertising and services

The Service may contain links to third-party websites and may display advertising served by third parties. We do not control those websites or advertisements, we do not endorse them, and we are not responsible for their content, products, practices or policies. Your dealings with any third party are solely between you and that third party.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure or error-free, or that any result it produces will be accurate, complete, current or reliable. You must not rely on the Service as your sole basis for any security, operational or business decision.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED US DOLLARS (USD 100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities. In those jurisdictions our liability is limited to the smallest extent permitted by law, and nothing in these Terms excludes liability that cannot lawfully be excluded.

11. Indemnity

You agree to indemnify and hold us harmless from any claim, demand, loss, liability or expense (including reasonable legal fees) arising out of your use of the Service, your breach of these Terms, or your violation of any law or of the rights of a third party, including any test you run against a host you were not authorised to test.

12. Termination

We may block, restrict or terminate your access to the Service at any time, with or without notice, if we believe you have breached these Terms or that your use harms the Service or any third party. The sections of these Terms that by their nature should survive termination will survive.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of the Service after a change takes effect constitutes your acceptance of the revised Terms. If you do not agree to a change, you should stop using the Service.

14. Severability and waiver

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later.

15. Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior understanding on that subject.
